This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and Kind Foundation (“we,” “our,” or “us”), governing your use of the Kind Blood Bank mobile application (“App”).
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this Agreement.
2. Restrictions
You agree not to:
- Modify, reverse-engineer, decompile, or disassemble the App
- Use the App for unlawful purposes or in violation of applicable laws
- Sell, rent, lease, or distribute the App without our prior written consent
- Interfere with or disrupt the App’s security or operation
3. User Responsibilities
- You must be at least 18 years old to use this App.
- You agree to provide accurate information when registering as a donor.
- You are solely responsible for your interactions with other users and for verifying their identity.
- You agree to use donor information only for the purpose of requesting or arranging blood donation.
4. Data Collection and Privacy
Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.
By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.
5. Intellectual Property
All rights, titles, and interest in the App (including code, design, text, graphics, and trademarks) remain with Kind Foundation or its licensors.
This Agreement does not grant you ownership of any intellectual property rights in the App.
6. Disclaimers
The App is provided “as is” without warranties of any kind.
We do not guarantee the availability of donors, the accuracy of donor information, or successful blood donation arrangements.
We are not liable for any medical outcomes, delays, or damages resulting from your use of the App.
7. Limitation of Liability
To the fullest extent permitted by law, Kind Foundation and its team will not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data or unauthorized access to your data
- Any harm, injury, or loss resulting from donor-recipient interactions
8. Termination
We may suspend or terminate your access to the App at any time without notice if you violate this Agreement.
Upon termination, your right to use the App will immediately end.
9. Changes to the Agreement
We may update this Agreement from time to time. Continued use of the App after changes are posted means you accept the updated terms.
10. Governing Law
This Agreement is governed by the laws of India/Kerala, without regard to its conflict of laws principles.
